The shop sells photographic fine-art prints created by M.P. Osborne.
Product pages describe the principal characteristics of each print, including available sizes, materials, edition information and price.
Many works are sold as strictly limited editions. Where a print is described as a limited edition, only the stated number of prints will be made available within that edition.
Limited-edition prints are individually numbered and supplied with a certificate of authenticity where stated on the relevant product page.
You can place an order by selecting the print, size, material or other available options and completing the checkout process.
You are responsible for checking that:
After placing an order, you will receive an electronic acknowledgement or confirmation.
An order may be declined or cancelled before fulfilment where, for example:
If payment has already been taken for an order that cannot be fulfilled, the amount paid will be refunded.
Limited-edition works are available only while edition numbers remain.
The website is designed to keep edition availability accurate, but in the unlikely event that an edition sells out before the website inventory is updated, I may be unable to fulfil an order.
If this happens, you will be contacted and any payment taken for the unavailable item will be refunded.
Edition numbers are allocated as part of the fulfilment process. Unless specifically agreed otherwise, purchasing a limited-edition print does not guarantee a particular edition number.
If a limited-edition print is lawfully returned and remains suitable for resale, that edition number may subsequently be offered for sale again. A return does not increase the total stated edition size.
Prices are displayed on the website in the currency shown at checkout.
The price payable is the price displayed when you place your order, together with any applicable delivery charge shown during checkout.
Any taxes that are required to be charged will be handled as applicable.
Payment must be made using one of the payment methods available at checkout.
Payment processing may be carried out by a third-party payment provider. M.P. Osborne does not normally receive or store your complete payment-card details.
Every reasonable effort is made to ensure prices are accurate.
If a product is accidentally listed at an obviously incorrect price due to a technical or administrative error, I am not obliged to supply it at that incorrect price where the error would reasonably have been apparent.
If this occurs after you have ordered, you will be contacted and given the opportunity to purchase at the correct price or cancel the order for a full refund.
Fine-art prints ordered through mposborne.com are professionally produced on my behalf by The Printspace, a specialist fine-art printing and fulfilment company.
Your sales contract remains with M.P. Osborne, not The Printspace.
The Printspace may manufacture, package and dispatch the print directly to the delivery address supplied with your order.
If you have a problem with an order, please contact M.P. Osborne rather than The Printspace unless specifically instructed otherwise.
Prints are generally produced specifically to fulfil each order, so there may be a production period before dispatch.
Any production or delivery times displayed on the website are estimates unless expressly stated otherwise.
Once your print has been dispatched, delivery times will depend on the destination and delivery service used.
I will make reasonable efforts to ensure orders are produced and delivered within the times stated.
I am not responsible for delays caused by circumstances genuinely outside my reasonable control, although this does not affect any rights you may have under consumer law where goods are not delivered within the legally required or agreed period.
You are responsible for supplying a complete and accurate delivery address.
Please check the delivery information carefully before submitting your order.
If an order cannot be delivered because incorrect information was supplied, you may be responsible for reasonable additional delivery costs required to resend the order.
This does not apply where the delivery problem results from an error by M.P. Osborne, The Printspace or the relevant delivery company.
Where international delivery is available, orders may be subject to local customs procedures, import duties, taxes or charges imposed by the destination country.
Where such charges are not collected at checkout, they may be payable by the recipient.
The availability and treatment of international orders may vary depending on destination.
Customers outside the United Kingdom are responsible for complying with applicable import requirements in their country.
Nothing in these terms removes any mandatory consumer rights that apply to you in the country in which you live.
Responsibility for the print remains with me while it is being delivered to you.
Risk passes to you when you, or another person identified by you to receive the order, takes physical possession of the goods.
If your order arrives damaged, defective or incorrect, please contact me in accordance with the Returns & Refunds Policy.
Every reasonable effort is made to represent each photograph accurately on the website.
However, screens and devices reproduce colour, brightness and contrast differently. The appearance of an image on your screen may therefore differ slightly from the appearance of the finished physical print.
Minor variations resulting from screen calibration or the characteristics of the selected fine-art printing material do not necessarily constitute a defect.
This does not affect your statutory rights where an item is faulty, materially different from its description or otherwise fails to meet the standards required by law.
Print dimensions are stated on the relevant product page.
Small tolerances may occur as part of professional printing, trimming and production processes.
Where dimensions are particularly important, for example, because a print is intended for an existing frame, please check the stated dimensions carefully before ordering.
For most standard products purchased online, UK consumers have a statutory right to cancel their order within 14 days of receiving the goods.
Full information about cancelling an order, returning a print and receiving a refund is set out in the Returns & Refunds Policy, which forms part of these Terms and Conditions.
Nothing in these terms limits your statutory cancellation rights.
Different cancellation rules may apply where you specifically request an item produced to your individual specification, such as:
Where a product falls within the legal exemption for personalised or genuinely bespoke goods, the normal statutory change-of-mind cancellation right may not apply.
Simply producing a standard print after an order is placed does not, by itself, mean that the print is personalised or bespoke.
Your rights in respect of faulty, damaged, incorrectly supplied or misdescribed goods are unaffected.

Depending on the circumstances and your statutory rights, an appropriate remedy may include replacement, refund or another remedy provided by law.

Nothing in either document limits rights provided to consumers by applicable law.
Purchasing a photographic print means you are purchasing ownership of the physical print only.
Copyright and all other intellectual-property rights in the photograph remain with M.P. Osborne, unless expressly agreed otherwise in writing.

You may, of course, display the physical print for normal private purposes and may subsequently sell or give away that physical copy.
For commercial image licensing or reproduction enquiries, please contact me separately.
Where a certificate of authenticity accompanies a limited-edition print, it forms part of the provenance of that physical artwork.
Customers are encouraged to retain the certificate with the artwork.
Loss or destruction of a certificate does not transfer copyright or reproduction rights in the photograph.
Replacement certificates may not always be available, particularly where ownership or provenance cannot reasonably be verified.
You are free to sell or transfer ownership of a physical print that you legally own.
Any subsequent sale transfers ownership of that particular physical print only.
Copyright and reproduction rights remain with M.P. Osborne.
M.P. Osborne has no obligation to facilitate, value, authenticate or participate in a subsequent private resale, although authentication enquiries may be considered where appropriate.
Reasonable care is taken to ensure that product descriptions, prices, edition information and other information published on mposborne.com are accurate.
Occasional errors may nevertheless occur.
I reserve the right to correct genuine errors, update information and make reasonable changes to the website.
Changes will not retrospectively reduce statutory rights relating to an order already placed.
Nothing in these terms excludes or limits liability where it would be unlawful to do so.
In particular, nothing in these terms limits your statutory rights relating to goods that are faulty, unsafe, not as described, not of satisfactory quality or otherwise fail to comply with applicable consumer law.
I am not responsible for losses that could not reasonably have been foreseen when the contract was made.
Products sold through the consumer shop are intended primarily for private use. I am not responsible for business losses arising from a consumer purchase, including loss of profits, revenue, business opportunity or commercial goodwill, except where liability cannot legally be excluded.
There may occasionally be circumstances outside my reasonable control that prevent or delay fulfilment, including significant courier disruption, industrial action, natural disasters, serious infrastructure failures or disruption affecting production facilities.
Where such circumstances materially affect your order, I will take reasonable steps to minimise the disruption and contact you where appropriate.
Your statutory rights relating to cancellation, delivery and refunds remain unaffected.
Personal information provided when you place an order is handled in accordance with the Privacy Policy published on mposborne.com.
Information necessary to produce and deliver your order may be provided to relevant service providers, including The Printspace, payment processors and delivery companies.
These Terms and Conditions may be updated from time to time to reflect changes to the website, business practices or applicable law.
The terms applying to your purchase will normally be those in force when you place your order.
The latest version will always be published on this website.
If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
These terms and purchases made through mposborne.com are governed by the laws of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom or another country, you retain any mandatory consumer protections and rights to bring proceedings that apply to you under the law.
